Vincent "Don Vito" Margera Found Guilty of Sexual Assault

Vincent Margera, also known as “Don Vito” on his nephew’s MTV show “Viva La Bam,” made a terrible scene while in Jefferson County courtroom on Wednesday during the judge’s reading his conviction for assaulting three young girls, according to media reports.

Margera was found guilty on two counts of sexual assault on a child, Wednesday, Oct. 31, in a Colorado courtroom. The 51-year-old uncle of MTV star Bam Margera had been accused of sexually assaulting two 12-year-old girls and one 14-year-old in mid-August, 2006, during an autograph session at the Colorado Mills skate-park.

According to the girls’ testimony, Margera groped the breasts of girls who had their photos taken with him. Rocky Mountain News reports on its website that one of the 12-year-old girls said that Margera touched her breast and said “big boob,” which embarrassed her very much.

The 14 year-old girl said Margera placed a stick on her breasts and inner thigh. Prosecutor Jim Stanley stated in court that Margera “was so intoxicated that he peed his pants while with these children.”

As Jefferson County District Judge M. J. Menendez read the first verdict, the 51-year-old former car painter fell to the floor saying, “Just kill me now. I can't spend my (expletive) life in prison. I didn't do anything.”

His attorney, Pamela Mackey, asked the deputies to take care of her client and try to calm him down without hurting him. In that very moment, four deputies rushed to help him raise from the floor while Margera was screaming out loud, “I can't stand up! My legs! My legs! I can't move.”

While the second verdict was read, Margera made another scene in the courtroom saying, “I didn't f------ do nothing. You can rot in f------ hell,” while the deputies and the whole courtroom looked at him in astonishment.

Pam Russell, a spokesperson for the DA’s office, said that there was concern that he might have breathing problems while the deputies were cuffing him and trying to calm him down. More deputies were brought to help as well as a paramedic with a defibrillator and a wheelchair. Soon after the second conviction was read, 12 police officers surrounded Margera and took him of the courtroom.

Denver District Attorney Scott Storey said that he was amazed by Margera’s behavior in the courtroom. “I've never seen a defendant plunge to the ground like that. It's definitely a serious verdict. Not knowing him, I don't know if that's a typical reaction,” he said.

One of Margera’s lawyers said that his client might have acted in a vulgar manner but that his acts were not meant to be made as sexual arousal or abuse; they were allegedly more in the way of his character on his nephew’s show, “goofy, outrageous and vulgar.”

Margera could be sentenced from two to six years to life in prison on December 20 and he faces a sentence of one to 18 months in prison for intentionally breaking the conditions of his bail.
