Wheelchair Student Sued for Running over Girl’s Toe

A 17-year-old student in a wheelchair is facing three misdemeanor charges for allegedly running over the toe of another student on the halls of the Rangeview High School in Aurora.

Joshua Martinez told television station KDVR-TV Wednesday that he was charged with assault, battery, and reckless endangerment for the way he drove his wheelchair inside the institution where he studied. He claimed not to recall when the incident happened and what the circumstances were.

Although a police report obtained by the television station reveals that Martinez sometimes tried to impress his classmates while his operating his wheelchair, the teenager’s father said he was completely shocked his son could be accused of wrongdoing.

"It breaks my heart that they would even try to attempt to accuse him of something so outrageous," said Michael Martinez, according to local news sources.

The boy’s family claimed that it was not their son’s fault that the hallways were always crowded, but witnesses quoted in the police report say Martinez actually moves around recklessly in his wheelchair, bumping people and sometimes riding on two wheels.

"Every now and then I just show off for my friends, but I make sure no one's around," Joshua admitted.

The boy has been disciplined for driving too fast before, and his father replaced his electric wheelchair with a manual one and since then, Joshua claims he had not been speeding anymore.

However, Joshua is due in court in May.
